Mr. Kessler focuses his automobile and 18 wheeler semi-truck law practice on Missouri and Kansas cities and towns including Kansas City Missouri, Raytown, Independence, Belton, North Kansas City, Kansas City Kansas, Edwardsville, Bonner Springs, Lenexa, Overland Park,  Olathe and Shawnee.

According to Missouri’s Crash Statistics, which is part of the Missouri State Highway Patrol, 113 people were killed in 2012 from commercial motor vehicle wrecks and 3,346 people were injured in those accidents.  Commercial motor vehicles according to the Missouri State Highway Patrol included semi-trucks having a gross vehicle weight of 10,001 pounds or more.  In 2012, 49 people were killed by heavy/large trucks and 639 people were injured according to Kansas’ Department of Transportation.

The truck driver or the company who employs the trucker can be responsible for a semi-truck accident.  Some common causes of 18 Wheeler accidents include:

Truck Driver Error or Mistakes:  Several things can cause truck driver errors which result in horrible accidents with resulting injuries or death in Missouri or Kansas.  Sometimes the semi-truck driver fails to adjust speed or driving while in traffic or bad weather.  The driver may turn or change lanes suddenly.  Sometimes drug or alcohol used by the driver can cause driving impairment which causes accidents.   Or the driver may be sleepy from working too many hours or shifts in a row.  Missouri, Kansas and Federal regulations have strict requirements for drivers including mandatory drug and alcohol screening, rest breaks, and other measures but, these are not always followed by the drivers or their employers.

Mechanical Problems Due to Poor Truck Maintenance:  When large and heavy trucks like big rig tractor trailers are involved in accidents, injuries are very serious and oftentimes fatalities happen in Missouri and Kansas.  Poor truck maintenance can be blamed for some of these accidents.  Such things a faulty back up warning systems, tire separations or blow outs, faulty brakes or engine failures cause crashes every year.  According to the Missouri, Kansas and Federal law, truckers and the trucking companies are supposed to perform routine truck inspections and repairs prior to hauling a load, but sometimes these inspections don't happen or are not thorough enough to catch mechanical issues that can cause trucks to crash.

Failure to Load Trailer Properly:  Sometimes cargo contents are improperly loaded in tractor trailers which result in horrific accidents.  This can include improperly secured freight, unbalanced loads and cargo overloading.  Loads can shift as a result which can cause the semi-truck to tip over or jack knife.

Negligent Selection of a Driver or Shipping Company:  The failure to conduct a proper background truck driver check or continuing to employ bad drivers is a major cause of error, which can lead to accidents in Missouri and Kansas.  Trucking companies can be held responsible for such practices.

Inadequate Training of Truckers:  Even though Missouri, Kansas, and Federal regulations require a truck drive to be properly trained, some trucking companies still do not follow this.
